Definitions for the purpose of these Terms and Conditions –

  • ‘concert’ or ‘event’ means an entertainment event organised by us, Give Music.

  • ‘you’ means the gift giver and the gift recipient.

  • ‘we’ and ‘our’ means the team at Give music.

  1. By buying a concert you are accepting that these terms and conditions will govern that purchase for you and any members of your group.

  2. No booking will be accepted until we have received full payment at which point a contract will come into existence between you and us.

  3. Once you have received your Give Music Concert, there are no available refunds.

  4. By submitting an online booking form you warrant to us that all details supplied by you are true and accurate.

  5. If we attend an event at the address given at booking and the details provided are inaccurate then we will be unable to perform and unable to reimburse you for the event.

  6. By buying an event you confirm the eligibility of the event address. We can only commit to performing outside and in the open air. For the safety of our customers and our team we cannot enter houses or perform in corridors for gift recipients in flats, maisonettes or nursing homes etc. If we arrive at an address and it is not compliant with the UK Government’s coronavirus legislation then we will not be able to perform and we will not be able to reimburse you.

  7. After payment has been made, refunds are no longer possible. However, you are able to apply, via email, for a change in the concert date. Each case will be treated individually and it is only the Give Music team who will decide on the suitability of a change.

  8. For the purposes of these Terms and Conditions, “Force Majeure” means any cause beyond Our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to you for failure to perform any obligation under these terms and conditions to the extent that the failure is caused by Force Majeure. However we will contact you as soon as possible informing you of the necessary cancelation and attempt to arrange with you an alternate concert date to suit all parties.

  9. Only in the case of a Coronavirus specific lockdown (local or national) or a change in local Coronavirus alert levels, which directly affects your booking, will we attempt to arrange with you an alternate concert date to suit all parties. However, in this case, you may elect to cancel your booking and receive a full refund which we will endeavour to refund as soon as possible but in any event within 30 days of the date of cancellation.

  10. Immediately after booking we will send a booking confirmation email to the billing email address. 3 days before the date of your booking we will contact you again to confirm a 3-hour arrival time window via the billing email. On the day of the event we will text or email the billing mobile number/billing email address when we begin traveling to the gift address. This will notify you that we are on our way. At this time we will approximate a more accurate arrival time. We will endeavour to arrive at the event address within the time window stated but we cannot be held liable for late arrival due to circumstances out of our control.

  11. It is your responsibility to ensure that you/your gift recipient is at the address ready to receive the event.

  12. If the gift recipient does not respond at the address on arrival then we will call the billing mobile number, the gift recipient mobile number (if it is different to the billing mobile number) and finally the additional contact number. If there is no response after any of these attempts then we will wait outside the venue for the duration of the standard concert booking (15 minutes) and then leave. Unfortunately, under these circumstances, we would be unable to reimburse you.

  13. Please ensure you/your gift recipient are following all current Government Coronavirus legislation and guidance. We would encourage you to wear a facemask and ask that you keep the relevant distance from the 'Give Music' team bubble.

  14. It is against current Government Coronavirus legislation and guidance to gather in groups of more than 6 people from more than one household or support bubble. Please ensure that you/the recipient and their household comply with this requirement.

  15. Do not encourage friends or neighbours to gather in advance of/or during the concert. Give Music does not accept liability for any person or party or the actions of any person or party present at the event who does not comply with these regulations or any other law.

  16. We are required by law to keep a temporary record of the gift recipient's contact details for 21 days and assist NHS Test and Trace with requests for that data if needed.

  17. The Give Music Chorus will be a maximum bubble of 5 members.

We will ensure safe practice of our bubble at all times, using masks (except when singing), sanitiser, social distancing and other recommended PPE as appropriate.

  18. We are unable to enter any residential dwelling or make physical contact with any recipient. One member of the team, wearing gloves and a mask, will knock on the door, leave the festive card on the doorstep and stand back to maintain the 2-metre rule. It is the recipient’s responsibility to sanitise their hands after receiving and opening the festive card. Whilst singing, we will be appropriately distanced from the recipient and each other.

  19. We accept no liability for any illness (including coronavirus) allegedly transmitted at a Give Music event.

  20. We have a risk assessment for our events, which you can request via email. Whilst we attempt to insure the safe running of our events we are not responsible for illness or incident relating to you or anyone attending during, before or after the event.

  21. Please ensure that the people in your party are following the latest government guidance with regards to coronavirus. If at any point we feel the safety of the Give Music chorus becomes compromised we will have to leave and you will not be reimbursed.

  22. If we make contact with the gift recipient who then verbally confirms that they are not receptive to your gift, then we will contact the booking number to confirm departure and then leave. Under these circumstances we would be unable to reimburse you.

  23.  If you sign up to our mailing list we will provide you with a discount code for £15 off your first concert. Please do not abuse this opportunity. We reserve the right to refund and cancel a concert if we are alerted to the fact that you have used this code more than once.

  24. You consent, and you will ensure that anyone with you consents, to being included in, and to the commercial exploitation of, any films and recordings made by us or third parties, without payment.

  25. 25% of our NET profit will be donated to Mental Health Innovations (legal name of Shout) (Registered charity, number: 1175670.)

  26. No credit card details are stored by Give Music. The Give Music website uses the payment processing platform ‘Stripe’ to take your one off payment. Please ensure you have read the Stripe Privacy Policy and Terms and Conditions. We will do our best to protect your personal information. However, we cannot guarantee the security of your data transmitted to our site before it reaches us, and any transmission is therefore at your own risk.
